Terms of Service

Effective date: May 9, 2026

These Terms of Service (“Terms”) govern your access to and use of the InstaDM service available at aipatnam.com(the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. By using the Service you represent that you meet these requirements.

2. Your account

  • You are responsible for the activity that occurs under your account.
  • Keep your password confidential. Notify us immediately of any unauthorized use.
  • You may not share your account credentials with anyone outside your organization.

3. Acceptable use

You agree not to use the Service to:

  • Send unsolicited bulk messages, spam, or content that violates Instagram’s Community Guidelines, the Meta Platform Terms, or applicable law.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Reverse-engineer, decompile, scrape, or attempt to bypass rate limits or security measures of the Service or of Meta’s platforms.
  • Upload or transmit viruses, malware, or any other harmful code.
  • Use the Service for any illegal, harassing, defamatory, hateful, sexually explicit, or fraudulent purpose.
  • Send messages on behalf of any Instagram account you are not authorized to operate.

4. Instagram & Meta connection

The Service uses the Instagram Graph API. By connecting an Instagram Business or Creator account, you authorize the Service to read post and comment data and to send replies and direct messages on your behalf. Your use of Instagram remains subject to Meta’s own terms, including the Meta Platform Terms and Instagram Community Guidelines. You are solely responsible for ensuring your use of the Service complies with those terms.

5. Your content

You retain all rights to content you upload or send through the Service, including the replies, DMs, and campaigns you create. You grant the Service a limited, non-exclusive license to store, transmit, and display that content solely as needed to operate the Service for you.

6. Service availability

The Service is provided on a best-effort basis. We may modify, suspend, or discontinue features at any time. We are not liable for downtime, data loss caused by Meta API outages or rate-limit changes, or message delivery failures returned by Meta.

7. Fees

The Service is currently provided free of charge to authorized users. We may introduce paid plans in the future; if we do, we will give at least 30 days’ notice and you will be able to choose whether to subscribe.

8. Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy, Section 7). We may suspend or terminate your access if you violate these Terms, if required by Meta, or if continued provision of the Service to you would violate the law.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) the content you upload or send through the Service, or (c) your violation of any third-party rights, including Meta’s terms.

12. Changes

We may update these Terms from time to time. The “Effective date” at the top of the page reflects the latest revision. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction where the Service operator is established, without regard to conflict-of-law principles. Any dispute will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection laws of your country of residence say otherwise.
